This is an English translation of the official version of the Website’s Terms of Use in Hebrew. In any case of inconsistency or discrepancy between the Hebrew version and the English version, the Hebrew version shall prevail.

Introduction

Welcome to the official website of the Israel Internet Association (Registered Association) (hereinafter: the “Website” and the “Association”, respectively). The Association’s registration number is 580299543, and its address is: 6 Bareket Street, POB 7210, Peach Tikva 4951774, Israel. The Website is available on the following URL – www.isoc.org.il – and through any other domain name, at the Association’s discretion.

Your use of the Website, including its content and the services it offers, constitutes your consent to these Terms of Use, which include by reference the Website’s Privacy Policy, as well as any additional instructions and rules that may be presented to you during your use of the Website (the “Terms”). In addition, these Terms will also govern your activity and participation in any of the Association’s online communities, professional forums and mailing lists (“Online Communities”), with necessary changes taken into consideration.

Please read these Terms carefully, as they define your rights and obligations with respect to your use of the Website and your participation in any of the Online Communities. Note that we might change the Terms from time to time and that you are responsible for getting updated about such changes through the Website. If you do not agree to the Terms, you are requested to abstain from using the Website.

The Terms govern the use of the Website on any computer or other device (such as smartphones, smartwatches, tablet computers etc.). In addition, they govern the use of the Website through the internet or through any other network or means of communication.

The term “content” shall mean any textual, visual or audio content, or any combination thereof (such as audio-visual videos), and any part thereof, as well as their design, adaptation and presentation.

The Association and the Website in a nutshell

The Association is an independent corporation working to promote the internet and assimilate it in Israel as a technological, research, education, social and business infrastructure. As part of this, the Association works to develop and promote infrastructure services that are critical for the internet in Israel, to bridge the digital gap in Israel, impart principles for safe web use, represent Israel in international forums important to determining the internet’s future and more. The Association is a nonprofit organization and as such, its work is performed for the benefit of the Israeli internet community and to promote the society’s purposes. Among its different activities in the field of infrastructure services, the Association manages the domain name registry under Israel’s country code Top Level Domains (“.il” and “ישראל.”) and the Israeli Internet Exchange (IIX). More detailed information about the Association and its fields of activity may be found on the Website.

The Website provides information, content and different services relating to the Association and its fields of activity (such as the Israeli domain-name registries, the Israeli Internet Exchange (IIX), net freedom, safe internet, net ethic, the “Block” initiative, constitutional rights on the web, web neutrality, etc.) that are intended for use by the general public, as well as interested parties in different fields, such as domain name holders, Association members, participants in Online Communities, and more.

The Website includes, among other things, information about the Association, its officers and its organizational structure; position papers on different subjects; events held by the Association and future events (including the option of registering for such events); information on public initiatives; training kits in different fields; various Online Communities; the Association’s contact forms, etc.

The Website also includes information on the Israeli domain name registry, including details on domain name registrars certified by the Association, a domain lookup mechanism (WHOIS), resolutions of the Association’s domain dispute resolution mechanism (ILDRP), resolutions relating to offensive domain names and more. The registration and management of domain names in the Israeli domain name registry is subject to the Association’s Registration Rules and the rules that accompany them (such as the Association’s dispute resolution mechanism’s rules), as well as any other contractual arrangement in place between domain name holders and the Association or any of its certified registrars. These Terms shall not derogate from the provisions of the such contractual arrangements.

The Association will decide, at its sole discretion, which content will be presented on the Website and Online Communities, the duration for which it is presented, its location and design and any other matter relating thereto. The Association may present on the Website additional content derived from social networks and other online platforms, such as the pages operated by the Association on Facebook. Note that you assume full responsibility for your use of social networks such as the foregoing or any other online service, and that your use of these platforms may be subject to additional terms and conditions (such as terms of use and privacy policy) governing the activities of such services. Such online platforms and services are not operated by the Association and are not under its control.

The Association’s Online Communities may also be accessed through the Website or other means of communication, such as email mailing lists, discussions on social media such as WhatsApp or Facebook, and on additional online platforms which are mostly operated by third parties, at the Association’s discretion. Using the services of any such third party during your participation in any Online Community is at your own risk and is subject to the agreements governing such third party services (such as those services’ Terms of Use and Privacy Policy).

The Website includes information and content in a variety of topics, including in professional and legal fields or other expertise. For the avoidance of doubt, it is hereby clarified that the content on the Website is intended to provide only general information and guidance. The use of the Website and the content published on it is not, and is not meant to substitute professional advice, legal opinion or consultation with an expert in the relevant field, if necessary. In case of doubt with respect to the need to receive any professional opinion or guidance, you must contact a relevant professional.

The Website also includes sections which illustrate content mostly designated to the Association’s members. Such content includes official Association documents (general assembly protocols and reports), elections information for the Association’s Board of Directors. As a matter of policy, such documents are publicly available and not limited to Association members only for review. The provisions of the Terms shall not derogate from the binding effect of the Association’s Articles of Association or the provisions of the Nonprofit Organizations Law, 5740-1980, on all matters relating to membership in the Association and activities under it.

Use of the Website

You are allowed to use the Website, its content and services, pursuant to the following rules. These rules will also govern your activity and participation in the Association’s Online Communities. Do not use the Website, its content or its services in any other manner, unless you receive the Association’s explicit, prior and written consent, and subject to the terms of such consent (if given) –

You are allowed to use the Website only for private, educational and academic needs, and for non-commercial purposes, unless explicitly stated otherwise;

You may not copy, use, or allow others to copy and use, in any other way, the Website’s content, including in other websites and applications, in electronic publications, in printed publications, and etc., for any other purpose.

You may not use or launce any automated system, including without limitation crawlers or robots and similar applications, to search, scan, copy, compile or automatically retrieve content from the Website. As part of this, you may not create or use such means in order to create a collection, selection or database containing content or information from the Website;

You may not present content from the Website in an exposed or concealed frame;

You may not present content from the Website in any manner, or use any software, device, accessory or communication protocol that changes the Website’s design or removes any content or information from it;

You may not link to the Website and its content from any source that include pornographic content, content that promote racism or prohibited discrimination, is illegal, or that encourages activity in violation of applicable law, or whose publication is against the law;

You may not link to Website content which is not the Website’s homepage (“deep link“) and you may not present or publish such content in any other manner, unless the deep link is to an internet page on the Website as-is, so that it can be displayed and used completely identically to its use and display on the Website. In furtherance this, you may not link to content from the Website separately from the internet pages on which they appear on the Website (for example – you may not link directly to a video on the Website, but only to the full page on which it appears). In addition, the exact address of the internet page on the Website must appear in the ordinary place designated for this purpose in the user interface (for example, in the status bar of the user’s browser). Do not change, falsify or hide this address and do not substitute it with any other address.

The Association shall not bear any responsibility for any damage caused as the result of any link to content deriving from the Website or from any presentation or publication of content in any other manner. You are fully and solely responsible for any link, presentation or publication of the content performed by you, and undertake to indemnify the Association for any damage caused as a result.

Registration

Using the Website does not require registration. However, different areas and sections of the Website, such as the areas designated for registration for membership in the Association, registration for various events held by the Association, registration for the Association’s mailing lists and Online Communities, contacting the Association using the online contact forms on the Website and more – may entail registration and provision of personal and identifying details, such as your full name, physical address, telephone number, active email address, organization, and additional details as necessary and according to the circumstances.

It is possible that in the course of providing such details, you may be required to actively and explicitly confirm your consent to the Terms or part thereof. You can only complete the registration in these cases after providing the necessary details, and after your consent to the Terms, or part of them, as required. Registration to the Association’s Online Communities may be conditioned in prior approval of the participants or other pre-conditions, in accordance with the nature and character of the applicable Online Community, at the Association’s full discretion.

In case you are requested to provide the above details for the purpose of using any of the Website’s services, you must provide your correct, accurate and full details. Providing false details may prevent you from being able to use all of the Website’s functions, undermine your participation in the desired activity or Online Community, and when necessary, prevent us from contacting you.

The information that you provide during registration, as well as additional details regarding your use of the Website or Online Communities will be retained by the Association. You have no legal obligation to provide the information, however unless you provide it, you will not be able to complete your registration. The Association will not use your information for any manner other than in accordance with the Website’s Privacy Policy, which forms an integral part of these Terms of Use.

Using certain parts of the Website may entail providing a username and password (as chosen by you during registration or as provided to you by the Association’s representatives), which will identify you in every login to the relevant section or Online Community. The Association may determine, from time to time, additional or other methods of identification. You must keep your username and password secret, so as to prevent their misuse. Make sure you change your password frequently, and in any case no less than once every six months.

Use of the Website’s sections that require registration, such as the Association’s Online Communities, as well as your consent to the Terms shall constitute your explicit consent to receive marketing materials from the Association and/or any person on its behalf, as this term is used in Section 30A of the Communications Law (Telecommunications and Broadcasts), 5742-1982 (also known as the “Spam Law”). Marketing materials will be sent to you according to the information you provided to the Association in the course of your registration. You may revoke your consent at any time by informing the Association of your refusal to receive advertising materials, in general or of a specific type, and sending a refusal notice. The appropriate method to send a refusal notice will be detailed in the marketing materials sent by the Association and/or any person or entity on its behalf.

The Association reserves the right to terminate your permission to use the Website’s sections that require registration, or your participation in any of the Association’s Online Communities, at its absolute discretion. Without derogating from the above, the Association may block your access to such sections, or cancel your registration to them, in any of the following cases –

If you deliberately provided false information;

In case of any act or omission by you, which adversely affects or may adversely affect the Association or any third parties, including other users or the Association’s service providers or partners;

If you use the Website, its services, its Online Communities, or any of its content in an attempt to perform any illegal act pursuant to the laws of the State of Israel, or any act which appears to be illegal, or in order to enable, facilitate, assist or encourage any such act;

If you violate the Terms;

If you perform any action which prevents others from registering to the Website or using it in any way;

If you provide the username and password allocated to you upon registration to any third party.

User content on the Website and Online Communities

The Association may, but is not obligated to, allow you to contribute and publish your own content as part of some of the Website’s sections, such as the online mechanism for presenting user comments, online discussions on the Website, and our Online Communities. Such content shall only be published in the areas designated for this purpose – whether on their own, in areas designated for user content on, or together with content that originates from the Association or others on its behalf. The upload or the provision of content for publication on the Website or in any of our Online Communities shall not grant you any right to demand the publication or continued publication of such content.

The Association encourages freedom of expression and facilitating fertile and productive discussions on the Website and within our Online Communities, with the active participation of you and other users. However, in order to allow relevant civilized and discussions and to prevent the abuse of the options you are given to express yourself, the Association may examine such content before its publication, but is not obligated to do so. Such examination may be performed by the Association on a sample basis, only to try to prevent the publication of content that is illegal, apparently offensive or inappropriate for the Website or the relevant Online Community, with no need for exercising legal discretion.

When uploading and publishing content, you are fully and exclusively responsible for any result deriving from such publication or upload. You must ensure that such content is legal. Among other things and by way of example only, you are prohibited from publishing, or from uploading to, the Website and Online Communities, the following content –

Any content that is false, misleading or falsified;

Any content that violates or infringes on others’ proprietary rights – including copyrights, trademarks and trade secrets;

Any content that is pornographic or of an explicit sexual nature;

Any content relating to minors which identifies them, their personal details or their addresses or contact details;

Any computer software, computer code or application that include a virus, including malware known as trojan horses, worms, vandals, malicious applications, etc.;

Passwords, usernames and other details, that allow use of computer software, digital files, websites, applications or services that require registration or payment, without such payment or registration;

Any content that constitutes libel about any person, that is harmful to his reputation or violates his privacy (without his informed consent);

Any content that personally identifies other people, without their consent to the publication of their identity;

Any content of a harassing, insulting, hostile, threatening or rude nature;

Any content that includes or promotes racism, prohibited discrimination on the basis of race, origins, color, ethnicity, nationality, religion, sex, occupation, sexual preference, disease, physical or mental disability, faith, political view or socio-economic status;

Any content that encourages performing any criminal offense or which may serve as the basis of a lawsuit or civil liability;

Any content which may mislead a consumer;

Any content of a commercial nature, or any content that does not conform to the Website’s principles, character or purposes;

The Association may refuse to publish, or immediately delete, any content that you provide for publication, at its sole discretion, including at any time that it finds that you violated the Terms or performed any act or omission that may adversely affect the services provided on the Website, its users, the Association or any person or entity on its behalf, including our Online Communities. In such circumstances, the Association reserves the right to prevent you from publishing and uploading additional content. The provisions of this section are in addition to any other rights or remedies provided to the Association’s by the applicable law.

If the Association decides to publish or use the content that you provided – it may edit any such content, at its absolute discretion, and as part of this abridge the content, add appropriate headings to it, etc. The Association is not obligated to state your name as the source of the content that you provide, but it may do so at its discretion.

Except where any other notice is given, the content you provide for publication will be exposed to all internet users (or to the participants of the relevant Online Community) and may also be presented as part of the Association’s other activities. Use caution and common sense when providing any personal information (such as your address or telephone number), with interactions with other users through the Website. Remember – When publishing content and if contacted by other users, you must exercise at least the same degree of caution and discretion you would in any other interaction over the internet.

The Association encourages you to exercise caution and common sense with regard to content published on the internet, including content published by other users. Content provided by other users is not published on behalf of the Association, and it therefore disclaims any responsibility for its reliability, integrity, accuracy or completeness, and is not responsible for any result of using or relying on such content.

Links

You may find links on the Website to various pages and content on the internet. Part of the content to which the links refer is not published by the Association or on its behalf and is not under the Association’s control or supervision. The fact that the Website links to such content does not constitute the Association’s approval or endorsement of such consent and does not guarantee that it is reliable, up to date or legal, the legality of the practices of the content owners with regard to privacy rights or any other aspects.

You may find such content inappropriate for your needs, or that you object to it, or find it provocative, annoying, improper, illegal or immoral. The Association is not responsible for content to which the links lead, and is not responsible for any result of using such content or relying on it. The Association does not warrant that the links on the Website will be correct or lead you to an active website, and it may remove from the Website links presented on the Website, or abstain from adding new links – all in its sole and absolute discretion.

Privacy

The Association respects your privacy while using the Website or engaging in any other of the Association’s activities. The Association’s Privacy Policy forms an integral part of the Terms. Since the Privacy Policy is subject to changes from time to time, it is recommend that you stay up-to-date and reacquaint yourself with it occasionally.

Contents of a commercial nature

The Association may place on the Website, at its sole discretion, contents of a commercial or promotional nature (for example, as part of a ‘display window’ of e-commerce websites), including content deriving from sponsors and supporters. The Association shall not be liable for content of a commercial nature published as part of the Website on behalf of third parties. The Association does not draft, examine, verify or edit the content or reliability of these publications.

The advertisers of commercial content shall bear the exclusive liability for commercial content and any result of use or reliance on it. The publication of content of a commercial nature as part of the Website does not constitute a recommendation or encouragement to purchase the services, properties or products which may be offered as part of the advertisements for sale. Any transactions made based on commercial content published on the Website are between you and the relevant advertiser. The Association is not a party to any such transaction and shall not be responsible for the services and goods offered in the commercial content on the Website or purchased through it.

Intellectual property

All copyrights and intellectual property rights on the Website, in services provided in it and in any content that it includes (excluding contents provided for publication by you or other Website users) belong to the Association, or to relevant third parties which permitted the Association to use them. You may not copy, distribute, publicly perform, broadcast, publish, change, process, create derivative works, sell or rent any part of the foregoing, whether by yourself or through or in collaboration with any third party, in any way or by any means, whether electronic, computerized, mechanical, optical, means of photography or recording, or by any other means or way, without receiving the prior, written consent of the Association or other relevant rights owners and subject to the terms of such consent (if given).

Without derogating from the generality of the foregoing, the Association is allowed to, and may, grant licenses to use of the content published on the Website, under a Creative Commons type license or any other user license. If and where the Association grants such a license, it shall clearly state so next to the relevant content, including information on the restrictions and terms of the license.

Trademarks and advertisements of advertisers on the Website (if any, including supporters and sponsors) are the property of such advertisers alone. These may not be used without the advertiser’s prior, written consent.

The Association does not claim ownership of the content that you upload and provide for publication on or through the Website or any of our Online Communities. However, by providing us with content for publication, you warrant that you own the full rights to such content and that you are permitted to provide such content for publication. If you are not the creator or owner of rights in the content that you provide for publication, you approve that you have legal authorization from the rightful owner, permitting you to provide the contents for publication and granting the Association the rights to use the content therein as detailed in these Terms.

The Association shall not be responsible for any damage caused as the result of a violation of the rights of the owners of rights in the content. You are fully and exclusively responsible for any link, presentation or publication or content created by you, and undertake to indemnify the Association for any damage caused as a result of such link, presentation or publication or content.

By providing the content for publication, you grant the Association a free, global and unlimited in time license, to copy, duplicate, distribute, market, publish, broadcast, process, edit, translate and use such contents in any other way, at its discretion, on the Website or any derivate thereof, in any media and/or in any other framework, whether electronic or printed. This license is granted to the Association for no consideration, including any credit, royalties or other benefits.

The Association respects the intellectual property of others. If you believe that your work was used in a way that violates any rights granted to you, you are invited and requested to immediately inform the Association of this in writing. Any actions taken by the Association, if any, on the basis of information or complaints delivered to it, shall not constitute proof of violation of any right.

Liability

Any reference in the Terms to the Association’s liability, or lack thereof, shall mean to include the liability of its employees, managers and agents acting on its behalf or in its name.

The use of the Website, the Online Communities, or any content or service in them shall be performed at your exclusive and sole liability, and the Association shall not bear any liability for any direct or indirect damage caused to you or any person on your behalf and to any third party, including any loss, damage or expense, relating to or resulting from, whether directly or indirectly, the Website, the Online Communities, and any content or service included in them.

The Association’s content and services are provided AS IS. They are not adaptable to the needs of each and every person. You shall not have any claim, demand or suit against the Association for the attributes of the contents, services, Online Communities, and the Website, or their capabilities, limitations or any rules associated with their use, and their compatibility to you or your needs.

The Association does not undertake that the content that you publish as part of the Website and Online Communities, or through them, shall receive any response, or that the Association shall allow you to publish such content. The Association cannot know what responses (if any) you will receive following publication, or who will respond to the content that you publish, and therefore it shall not bear any liability toward you (or any person or entity on your behalf) with respect to such responses, the identity of those contacting you or any result of publication. The Association shall not be responsible for any third party’s use of the content that you publish.

You are exclusively responsible for any decision made with respect to content published on the Website and Online Communities, or its use. The Association does not warrant that the contents or services of any third parties, including the content and service providers and of users, published on the Website and Online Communities, if any, are full, correct, legal or accurate, or that they correspond with your expectations and demands. The Association shall not bear any liability for any result deriving from them, or from their use, or from your reliance on them. Your use of the Website and Online Communities is at your sole responsibility.

The Association does not undertake that the Website’s services and content, or any of its Online Communities, will be provided regularly or without interruptions, conducted safely and without mistakes, or that they will be protected against any unauthorized access to the Association’s computers and databases, or against damages, malfunctions, failures or defects – in hardware, software, in communication systems, of the Association or of any of its service providers.

Indemnity

You undertake to indemnify the Association, its employees, managers or any person or entity on its behalf for any damage, loss, loss of profit, payment or expense that it is caused – including attorney’s fees and legal expenses – due to any breach of these Terms or any other terms. In addition, you shall indemnify the Association, its employees, managers or any person or entity on its behalf for any claim, suit or demand made against them by any third party as the result of content you provided for publication as part of the Website and Online Communities, or through them, as the result of links you made or any other use you made of the Website and Online Communities.

Changes and suspension of activities

The Association may, without prior notice and from time to time, change the Website’s structure, appearance and design, the scope and availability of the services in it, and shall be allowed to change any other aspect relating to the Website. The Association may also change, update and terminate any of its Online Communities. Such changes shall be made, taking into consideration, among other things, the dynamic nature of the internet and technological and other changes. By their nature, changes of this type may involve malfunctions or cause inconvenience. You shall not have any claim, demand or suit against the Association for making any such changes or due to failures that occur in their performance.

Without derogating from the above, the Association shall be allowed to suspend at any time the provision of the services on the Website, in whole or part. If possible, the Association will publish prior notice on the Website regarding the suspension of the services, a reasonable time in advance. Upon the suspension of the services, the Association will retain the content and information included in the Website for a reasonable additional period of time, after which the Association may delete such content and information, without maintaining any backup and without any prior notice.

Changes in the Terms

The Association may change these Terms from time to time. If any material changes are made in these Terms, a notice of these changes shall appear on the Website’s homepage 30 days before the coming into effect of such changes. If other nonmaterial changes are made in the Terms, a notice shall be published on this matter on the Website’s homepage 7 days before they enter into effect – this unless changes are made in the Terms pursuant to the provisions of any law, or order of any competent authority, in which case the changes shall enter into effect pursuant to the provisions of such law or order. Further use of the Website after the change of the terms constitutes your consent to the new Terms of Use and/or relevant Terms. If you do not agree with the updated version of the relevant Terms, you must refrain from making any additional use of the Website.

You may, at any time, review the up-to-date terms by clicking the appropriate link on the Website.

Law and Jurisdiction

The use of the Website, or participation in any Online Community, shall be governed only by the laws of the State of Israel. The competent courts in the Central District, Israel, shall have exclusive jurisdiction over any matter or dispute arising from the Terms.

Assignment

You may not assign or transfer rights by virtue of the Terms without receiving the Association’s prior, written consent. The Association may transfer its rights in the Website or any part thereof to any third party, at its sole discretion, as long as such party assumes toward you any of the Association’s obligations pursuant to the Terms.
