Background and arguments of the parties:
The Complainants are part of a Belgian corporate group and are the owners of the “Berghoff” brand. Respondent 1 is an Israeli company that holds the domain name berghoff.co.il (“the Domain Name”).
The Complainants filed a complaint seeking the transfer of rights in the Domain Name to them. Following the filing of the Complaint, the parties informed the Panel that they had reached a settlement. The settlement included agreement to the Complainant’s request, and in particular, the transfer of the Domain Name to Complainant 1.
Decision:
The Panel granted binding effect to the parties’ agreement and ordered that the rights in the Domain Name be transferred to Complainant 1.
