Background and arguments of the parties:
The Complainant filed a Complaint for the transfer of rights in the domain name nirometal.co.il (“the Domain Name”), which is held by the Respondent.
The Complainant is a long-established Israeli company, operating since 1965 in the field of equipment for institutional and industrial kitchens. The Complainant held the Domain Name for over 15 years and operated its website through it. The Complainant argued that it delayed, in good faith, the renewal of the Domain Name, and when it attempted to re-register it, discovered that the Respondent had preceded it. The Complainant contacted the Respondent requesting the transfer of the Domain Name to its holdership; however, the Respondent refused, and therefore the Complaint was filed.
The Respondent, a resident of Kazakhstan, did not submit a response to the Complaint.
Decision:
In light of the Respondent’s failure to respond, and the Complainant’s presentation of sufficient and persuasive evidence that it built its reputation through activities conducted using the Domain Name and is identified by the public with the Domain Name, it is concluded that the Complainant’s claims are well-founded and that the conditions required for granting the requested remedy are met.
The Panel upheld the Complaint and ordered that the Domain Name be transferred to the Complainant.
