Background and arguments of the parties:

The Complainant, a company based in the United States, filed a Complaint for the transfer of rights in the domain name mounjaro.co.il (“the Domain Name”), which is held by the Respondent, a resident of Ukraine. Following the filing of the Complaint, the Respondent notified the Panel and the Complainant by email that he waives his rights in the Domain Name. The Complainant requested that the Panel honor the Respondent’s request.

Decision:

Rule 11 of the Rules for Dispute Resolution provides that, “subject to the registration rules, the adjudicator or panel may conduct the proceeding in such manner as it considers appropriate, taking into consideration the objective of providing rapid resolution of disputes and the technology available at the time of the proceeding.” This rule is parallel to Rule 10(a) of the Uniform Domain Name Dispute Resolution Policy (UDRP).

While the Rules for Dispute Resolution do not specify how the Panel should act in cases where the parties reach a settlement or agreement prior to the issuance of a decision, Rule 17 of the UDRP establishes a normative framework that enables the parties to reach an agreement and enter into a settlement between them.

The Complainant referred to a prior decision in which a panel gave effect to the parties’ agreement. The Panel’s authority to issue a final decision giving effect to the parties’ agreement may be derived from several sources, including the general authority conferred upon the Panel to render a final decision in the matter before it, as well as by analogy from the general authority granted to it by law. Additional grounding is found in Rule 11, as acceptance of the parties’ agreement provides a rapid resolution to the dispute between them.

The Panel gave effect to the parties’ agreement and ordered that the rights in the Domain Name be transferred to the Complainant.
